There is no penalty; If you've spent 40 points, you get 40 points back. If you've spent 50 and had 5 unspent, you now have 55 unspent.
But the main stats cost increasing amounts of skill points per buy, so if you previously had several stats at 5, and this time increased one or more stats to 6-10, that would tank a lot of extra points.
Like, it's a 1/1/1/1/2/2/2/3/3/3 kinda dealie for the main stats. So just going to 5 is relatively cheap, going to 10 is much more expensive.
