if it's not already there do you guys think that if in terms and condition of ubisoft updated it, say, ' anyone using hacking and exploiting tools are liable for the damage of the company product and will be sued or prisoned.' Will this help or not ?

We already have a stipulation about "Forbidden Conduct" in the terms of use, which does include cheating and can result in a PermaBan as the maximum sentence, but as far as I'm aware there aren't any actual Governmental laws against using third party accounts, therefore it would be very difficult to actually prosecute someone over it.
More-so, I don't think anyone would actually read it, honestly.

Whatever mojo they applied in the latest patch to stop people from cheating was obviously not directed towards the normal kinds of cheating that infests public servers and matches.
As stated in the Top Issues Blog, it is an ongoing process. It's not something we planned to be solved in a single patch. It is a process that will take a bit of time to kick in properly.

1. Ubisoft uses any and all information they have to statistically identify cheaters. This includes all account information, play statistics, performance history, anything, everything ... if Ubi has one iota of data then they use it to identify cheating.

2. Anyone guilty of any cheating of any kind is permanently banned from all Ubisoft games for their entire life. This includes all accounts, all emails, all purchase information, and all authentication systems related to the player. Permanent. Lifetime. Ban. Period.
As I have explained before, there are legal laws the company has to abide by. There are laws that restrict from using certain information like this.
