We do take the circumstances into account to a degree when reviewing reports we receive about inappropriate chat. For example in the case you provided, it appears the account only received a warning rather than a suspension or ban as that language was not directed at someone else. The language itself is still not appropriate however, so when that report was received and found to be a violation, the warning was issued.
While I can completely respect that you'd prefer to stand up for yourself, we don't permit any chat that violates the terms of the User Agreement, period. For that reason it's generally best to simply report and mute a player if they're harassing you, rather than resorting to similar language as them.
We do investigate every report, so if you reported any of the players or accounts from the examples you brought up here, those would be actioned accordingly. We don't discuss any actions taken on another individual's account, but I can definitely understand the lack of feedback can make it difficult to tell when your reports have led to some action being taken. That's definitely something we've heard from others as well and have passed along.
As you mentioned, the ToS team is the only one able to review account actions. If you've appealed multiple times and they've decided not to remove any particular sanctions on the account, that is not something we'll be able to change either.
