Yes, you should be able to get skins without having the character. They should stay. I have the battle pass pink Clown outfit without owning Clown.

To explain this, it's also stated in a comment by Dead by Daylight underneath, we do not issue bans without any proof. There are multiple bannable offenses that can get you banned, one of them being repeated harassment. This always has been bannable.
